In U.S. energy markets, crude oil, refined products and natural gas pipelines play a significant role in delivering America's energy needs. Along with challenges of climate change and changing political attitudes, an increasing number of complex laws and regulations govern the pricing of and access to the transportation of crude oil, refined products and natural gas resources. Bill’s representation of interstate natural gas and crude oil and products pipelines before FERC extends to rate cases and investigations, tariff filings and compliance matters. His work has also included participation in FERC hearings before Administrative Law Judges, rulemaking dockets, formal and informal enforcement investigations and related appellate matters. He also has represented major new natural gas pipeline projects in obtaining Natural Gas Act certificate authority from FERC, assisting with assuring compliance with the related environmental regulations under the National Environmental Policy Act, as well as satisfying all other federal and state permitting requirements.
Bill has worked with local counsel in organizing and executing pipeline right-of-way and land acquisition programs. In connection with the development and financing of pipeline projects, Bill also advises clients with respect to the due diligence associated with the most tax effective financing structure and the execution of commercial arrangements with shippers and lenders. Comprehensive due diligence is critical in these areas, particularly with respect to understanding FERC’s rate regulation and evaluating the level of projected future revenue streams. Bill also has substantial experience in assisting clients in determining whether natural gas pipeline facilities are FERC-jurisdictional transmission or exempt gathering facilities and whether they qualify to provide transportation under the Natural Gas Policy Act.
Following the enactment of the Energy Policy Act of 2005 and the enhanced enforcement and penalty authority that Congress granted FERC, pipeline clients regularly have turned to Bill for representation in FERC enforcement matters. Representative clients in such matters have also included a broad non-pipeline spectrum, ranging from small energy producers and traders to major financial services firms engaged in energy transactions. Bill has been successful in resolving several FERC Enforcement proceedings that were closed at an early stage without a public order issued by FERC.
